And sadly most of the public still is not! They figure that as long as the noise isn't loud enough to cause pain, it isn't loud enough to cause damage. I'm not commenting on the merits of the lady's lawsuit; I'm just saying that it's not "common sense" to avoid concerts (or to at lesstvuse plugs) if you are unaware of the potential dangers involved in attending! smn

What she should have done is left and asked for a refund if she found the noise level to be distressing. She said it was incredibly loud due to the "shrieking fans". Considering this is a mature adult woman who's auditory system is fully developed imagine the teeny bobbers screaming their lungs out. I wonder how many kids ended up with hearing damage or tinnitus.

Ringing tinnitus is extremely common after concerts, but disappears in everyone after 2 to 24 hours, provided you haven't 'got the wind up' Fear that you have done damage to the ear creates a conditioned response which makes the hearing cortex monitor its own internal sounds. It is essential to understand that the music of the brain is harmless. This is quite separate from the understanding that repeated exposure to over loud noise will eventually reduce hearing (with OR without tinnitus), so care should be taken.

Common sense is not something that has to be instilled in you through your parents. It is "common" because everybody--regardless of who you were raised by--should know it. I am sorry, but the overwhelming majority of the public has absolutely no clue as to what a safe decibel level is and for how long they can be exposed to it. I didn't before I got tinnitus, and I am not even certain after all of the research I have done if I still know what is a safe decibel level and what is not. The fact is, if wearing ear protection truly was common sense (remember what "common" means, after all), you would see practically everybody in the concert wearing ear plugs. As we know, that just is not the case.

Posts: 763 07/13/12 8:05 AM Reply Quote More My Recent Posts	education and legislation would have prevented this. since legislation isn't going to happen in this country, if it did we would have decibel restrictions on mp3 players, like Europe. our only hope is education. schools especially should be talking about this. public service announcements and black box type warnings on packaging to. oh, and the ever hopeful but not going to happen old rocks stars getting together for a fund raising awareness concert with free earplugs and reduced volume. bill shatner and dave letterman as co mc's.

She won't recover if the judge determines that the concert venue and acts have no duty to protect the public concert goers from deafening noise (hopefully, the judge is better than this) OR she won't recover if the jury determines that she assumed the risk by going to the concert (highly likely) or was contributorily negligent by not wearing ear plugs (also likely). I really, really hope she prevails. People knock personal injury lawyers, but nothing is better at instituting necessary change like the threat of litigation. If this gets enough attention, it might actually raise awareness about the issue.

Yeah, personal responsibility as well, but nobody knows what tinnitus is like till they get it. And a good part of the population have not even heard about it at all (I, for one, never heard of it before I got it).

I agree that awarness level is certainly lacking. There should be some kind of icon adopted for use at the entry to loud events or on advertisments to represent noise hazard like there are ones for inflammable and toxic materials or a requirement for a banner with warning like on cigarette packs. Then if the warning is absent and the loudness was exceeded it would be much easier to bring it to court.
